Our website, property of the private company under the corporate name “ASTHENIS PRIVATE COMPANY” and the distinctive name ‘’ASΘENIS’’, which is located in Piraeus, Attica, at 7 Sotiros Dios Street, hereinafter referred to as “asthenis”, offers its information and services under the present detailed terms of use. Each user is requested to read the following terms of use before using asthenis’ services. The user should not use the website, if they do not agree with said terms, but should communicate to us any comments, in order for the latter to be examined in the spirit of good faith and fair trade practices.

 

  1. Introduction

Asthenis offers to the website’s users information pertaining to the services it provides and their terms as well as advertisements. It also allows the users to communicate with asthenis, by means of entering their personal details in a communication form, in order to submit their requests, queries, complaints, views etc.

Specifically, through this website, users can make purchases of products and dietary supplements that they or their doctor deem appropriate for them. In addition, the user may contact us to ask questions and queries relating to their purchases.

The user can also find a list of doctors working with us, their contact details, and contact them if they wish. Finally, our site provides a number of scientific articles related to health which have the sole aim of providing information to the public.

In the event that users choose to register as members of our site, they can, if they wish, by providing us with some additional information requested, receive materials including a fitness exercise programme, dietary suggestions, as well as information material related to physical and mental health.

All the existing services, as well as any new services that may be added to the website in the future, are governed by these terms of use.

 

  1. Terms of Registration & User’s Obligations

The user of the website is informed about all the services that asthenis provides and how the user may receive said services. If the user wishes to use our services by purchasing a product, or if they wish to subscribe for receiving informative and fitness material or dietary suggestions and ideas, or if they enters their personal details in the communication form, which is available via the website, in order to express a request, complaint, report etc., they should enter their true, full and current personal details, as required by the website, which they accepts that they may be used by ASTHENIS to contact them.

Users of www.asthenis.gr are obliged to use the website only to submit legitimate inquiries and / or orders, not to make false or fraudulent orders, otherwise Asthenis has the right to cancel them and inform the relevant authorities.

Breach of this obligation may constitute a criminal offence under applicable law. Any such breach will be reported to the relevant law enforcement authorities. Similarly, in the event of such a breach, the user’s right to use this website will be immediately terminated.

The user of the website’s services, fully and undeniably accepts that all the information/ services of the website are provided “as is” and asthenis bears no responsibility regarding the limited time, the accuracy of the information, the erasure, the poor operation, inability to electronically store user’s data, as well as any damage that may occur as result of the website’s use. The use of the website is governed by Greek Law, which is binding for each user, and the latter is obligated to comply with it. Furthermore, the user must use the website’s content and services according to the Greek legislation, the principles of morality and these terms and abstain from any action, which may offend other users or create problems to the proper operation of the website.

Additionally, the user must be 18 years or above. In any other event, you should not access our website and use our services and, accordingly, asthenis bears no responsibility for said use. If you are the parent or guardian of a minor, who uses the website, you have full responsibility for said use, including any financial obligations arising therefrom.

 

  1. Limitation of asthenis’ Liability

Asthenis makes any possible effort to ensure that the website’s services are provided without interruption and free from any technical errors. Furthermore, Asthenis has implemented all appropriate technical and organisational measures, which are required and which Asthenis is obliged to implement under the General Data Protection Regulation (EU) 2016/679, in order to secure the users’ personal data.

Asthenis’ liability is limited to the amount of the purchase price of the specific product purchased by the user/customer from our website unless expressly stated otherwise in these Terms.

Asthenis shall not be liable in the event that the user/customer of the e-shop makes a purchase using a credit/debit card of which they is not the holder.

Asthenis is not liable in the event that, for any reason, including a case of negligence, the website’s operation is suspended or the access to the website becomes difficult or impossible or if, despite the implemented security measures, “viruses” or other malicious software is traced and transmitted to the users’ terminals or if third unauthorized persons (hackers) interfere with the content or the operation of the website and render its use difficult or create problems in its operation.

Asthenis reserves the exclusive right, which the user unconditionally accepts, to permanently or temporarily suspend the website’s operation with or without a prior notice to users.

 

  1. Exclusion of Liability for the Provided Information

Asthenis is committed to the integrity and validity of the information provided only on its website in relation to the description of the essential characteristics of each product available, without prejudice to any technical or typographical errors that have been missed or have occurred unintentionally or due to any interruptions in the operation of the website for reasons of force majeure.

The description of the products on our website, their properties and characteristics, as well as their purpose, is a copy of those stated by their supplier and is included in their packaging, without any interference or involvement of Asthenis.

Asthenis is not responsible for the truth, correctness or accuracy of the descriptions of the products made by third parties, nor for their suitability in relation to the purpose for which they are intended, nor for the effect of the diet and fitness recommendations on the user. Therefore, for any direct or consequential damage incurred by the customer/user due to the use of the product in accordance with the statements of the supplier/seller/manufacturer, Asthenis is not liable for any compensation.

In any case, we recommend that you consult your doctor for any specific issue, indicatively mentioning heart problems, allergies, etc. ragarding the purchase and consumption of dietary supplements and their suitability, as well as the suitability of the diet and fitness suggestions we provide you, in case you wish to follow them.

We are not responsible for any technical problems that may occur to users when they attempt to access the website or during their visit to the website and that are related to the operation or compatibility of their own infrastructure with the use of the website. Furthermore, ASTHENIS shall not be liable for acts or omissions of third parties and in particular unauthorised interventions by third parties in products and/or services and/or information available through its e-shop. Where this website contains links to third party websites, www.asthenis.gr is not responsible for the content of these pages and for any damage or harm that may arise from their use, as the visitor has access to them exclusively by his own choice and responsibility.

Asthenis is not in any way liable for the content of the advertisements, which are posted on the website, or the communication of a user with third parties who are advertised on the website. Furthermore, Asthenis is not liable for any matter that may arise, if a user enters into a commercial transaction of any nature with an advertised third party. The advertisements, which are posted on the website, cannot in any way be deemed as advice nor do they imply that Asthenis encourages specific actions or the preference of a certain advertised product. Therefore, each user uses the provided services/information of the website exclusively on their own initiative.

Intellectual property rights on the content and services of the website, including indicatively texts, pictures, designs, commercial and financial data, programmes, any type of archives, trademarks/logos, are protected under the Greek, EU and international intellectual property rules and are exclusively a property of Asthenis, they are made available to the users strictly for personal information purposes.

Asthenis, always within the limits of good faith and fair trade practices, makes any reasonable effort, in order to ensure that the content and the information available on the website is as accurate, comprehensive and true as possible. Moreover, it is prohibited to copy, distribute, transfer, alter, sell, produce derivative work or mislead the public regarding the true provider of the website’s content. Any reproduction, republishing, uploading, announcement, transmission or any other use of the website’s content, in any way or by any means, for commercial or other purposes, is permitted only upon a prior written permission by Asthenis or any other beneficiary of the intellectual property. In any other case, the above actions may constitute an infringement of our intellectual property rights. We reserve the right to claim any positive and consequential damage we suffered, pursuant to the provisions of the legislation in force.

The website’s user acknowledges and agrees that we are entitled to commercially exploit (ourselves or through a third party) the entire content available on the website.

We attach great importance to the protection of the personal data of our website’s users. This is why we have undertaken all necessary actions, to comply with all the personal data protection rules. We process “personal data” in accordance to Asthenis’ PERSONAL DATA PROTECTION AND PRIVACY POLICY, as well as to the European legislation and any other applicable legislation in relation to the record keeping, processing, access and transfer of personal data. The website www.asthenis.com, where the abovementioned PRIVACY POLICY is always available, and which requests any information, collects, retains and safeguards said personal information, in accordance to the terms and conditions mentioned in the Policy in detail, as well as pursuant to the legislation in force and the applicable regulations and directives. Said policy is applied in personal information (as defined below), which is collected by this website.

We only collect personal data that concern you, if you opt to provide them to us by making a purchase from our e-shop, by filling out the communication form and only by your own initiative, if you wish to submit a request, complaint, opinion, query etc. to us or by answering the questionnaire we provide you with in case you wish to receive information and material for physical exercise and dietary suggestions. We do not share any personal data with third parties for their own commercial benefit, unless you have explicitly provided a relevant permission. Please read these terms as well as the PRIVACY POLICY, in order to learn more on how we collect, use, share and protect the information on the internet.

Collected information

Personal information: You may visit our website without providing us with any personal information, to be exclusively informed about Asthenis and the services we offer. We may only collect your individually identifying information (such as name, surname, email, phone number, address, email content etc), only if you choose to provide it to us.

Aggregate information: In some occasions, we remove the individually identifying information from the data that you have provided us with and retain them in an aggregate form. We may also combine these data with other information, to produce anonymous, aggregate statistical data (for example the number of complaints etc.), which help us improve our products and services. 

Your options

You may decide that you do not wish to send any identifying information, by not entering said details in any website field and not using an available identifying service, if any. If you opt to submit personal data, you have the right to review and rectify or even erase said data at any time, by accessing your application, if permitted by law. If you select specific uses or communications, for example receiving electronic newsletters, you may terminate your registration at any time, by following the instructions mentioned in every communication. Should you decide to terminate your registration with any service or communication, we will ensure that your data will be removed without undue delay, although we may require additional information before satisfying your request.

Security

We use technology, security measures, rules and other procedures, in order to protect your personal data against any unauthorised access, misuse, notification, loss or destruction. In order to secure the privacy of your data, we also use firewalls and protection programmes, according to the international standards of the market. Nevertheless, it is your responsibility to ensure that the computer that you use is sufficiently safe and protected against malicious software, such as Trojan, viruses etc. You should be aware that without sufficient security measures (e.g. safe browser setting, updated software against viruses, efficient firewall, not using software from dubious sources, etc.), there is a risk that your data, as well as the passwords that you use to protect access to your data, will be communicated to unauthorised persons.

In case of inactivity of the user for 30 minutes, the user is automatically logged out from our online store.

The information or personal data you provide us with is subject to processing under the Data Protection Policies. By using this website, you consent to the processing of such information and data and you declare that all information and data you provide to us is true and accurate.

For your own security, you should also treat all information provided through the service as confidential and proprietary and you should not disclose it to third parties.

Our website is addressed to adults. We do not collect individually identifying information about any person that, to our knowledge, is under the age of 18. The person exercising parental responsibility has the right, upon request, to be informed about the details provided by the minor and/or demand their erasure.

Update of the privacy statement

Asthenis may from time to time review the content of the terms of use and the privacy policy for the protection of the personal data on the website. Said amendments shall be available on this webpage without delay. The continuous use of our website shall constitute a declaration of your consent for the use of its updated features.

Asthenis periodically sends newsletters. Users receive them only if they opt in and for as long as they wish.

Asthenis is not responsible for the successful delivery of the newsletters although every effort is made with the ISP’s (Internet Service Providers).

Newsletters may end up in the spam folder, so please check regularly that they are not saved in that folder.

If you no longer wish to receive newsletters, you can unsubscribe from the list by clicking on the link contained in the newsletter.

  1. Availability of Services

The products sold through Asthenis’ e-shop are only available in Greece.

 

  1. Product availability

All product orders are subject to availability. In the event of supply difficulties or stock depletion, we reserve the right to inform you of similar products, of equal or superior quality and value, which you may order or to inform you of the possible delivery time of the product you have ordered and which is currently unavailable. If you do not wish to place an order, we will refund the full amount you may have paid.

If the unavailability relates to part of your order, any remaining order may be fulfilled properly, unless you inform us that partial fulfilment of the order would not serve your needs or interests.

 

  1. Customer/user identification – Registration

You can create your own account and register as a user. Two identification codes are used to identify you: the login code (e-mail or username) and the personal secret security code (security code/password). Each time you enter them they provide you with access to your personal data in security.

You are allowed to change your personal secret security code (security code/password) and your e-mail address at any time. Your personal data can be accessed by you, through the above mentioned codes, and you are solely responsible for maintaining their secrecy and keeping them confidential from third parties. In the event of their loss or leakage you must immediately inform Asthenis, otherwise we are not responsible for the use of the secret code by unauthorized persons.

For security reasons, we advise you to change your password frequently and avoid using the same and easily traceable codes (e.g. date of birth). We also recommend that you use not only letters and numbers but also symbols to create a password.

 

  1. Purchase without registration/Purchase as a guest

This website allows purchases through the “purchase as a guest” function. This mode of purchase requires only the necessary data to process your order (as described in the Privacy Policy). Upon completion of the purchase process, you will be given the option to register as a member or continue as a non-registered member.

 

  1. Product Price

The price of each product is the price set at all times on our website, except in the event of an obvious error. Prices are subject to change at any time without notice. Such changes do not affect orders you have already placed. The prices on our website include VAT as applicable in Greece, but do not include any shipping costs that may be incurred.

 

  1. Execution of the Agreement

The information contained in these Terms and Conditions and the details contained on this website do not constitute an offer to sell but an invitation for information. No contract will be deemed to have been entered into between us until your order is expressly accepted by us. If we do not accept your order and the order price has already been deducted from your account, then it will be refunded in full.

Please follow the steps in the form to place an order. Add the products of your choice to the “shopping cart”. Before completing the order (checkout), you will be informed about the products you have selected and in order to continue you must check the relevant box to select (checbox) “I have read and accept the terms of use and privacy policy”.  You will then receive from Asthenis an automated e-mail confirming the receipt of your order (“Order Receipt” / “Processing” / “Processing”).

This does not mean that your order has been accepted, but it is a proposal from you to our company to purchase one or more products. All orders shall be subject to acceptance by us. Such acceptance will be confirmed, within three (3) working days of the order, by sending you an e-mail (“Order Confirmation” / “Under execution”) stating the details thereof. Upon this point, the contract between us will be concluded. The contract will only apply to the products whose order we have confirmed in the Order Confirmation. We are not obliged to supply you with any further products that may be part of your order until we have confirmed the order for those products in a separate Order Confirmation. Finally, you will receive an e-mail (“Delivered to courier”) confirming the delivery of the product to the courier company.

In case there is any pending issue regarding your order you will receive a relevant e-mail and/or sms. Alternatively, we will contact you on the contact number you have provided when registering or entering the order on our website.

These updates cannot be deactivated, since sending them is a prerequisite for the execution of your order. We invite you to keep these e-mails throughout the duration of our transaction. In the event that you do not receive the relevant e-mails, you are obliged, in accordance with the general conditions governing our transactions, to inform us without delay.

 

  1. Rejection of Order

We reserve the right to withdraw any product from this website at any time and/or remove or edit any material or content without liability to you or any third party.

Whilst we make every effort to process all orders placed, there may be exceptional circumstances in which we may need to reject the order after we have sent you the message : “Order Confirmation” / “Under execution”, which we may do at any time in our absolute discretion, without any liability to you or any third party. In this exceptional circumstances, you may request a credit of the amount paid for future purchases or a refund.

Asthenis reserves the right to reject the order in case the user has cancelled two (2) previous orders and proceed to the exclusion of the user from using the e-shop of the website.

 

  1. Cancellation of the Order

You may cancel your order in the following cases:

  1. a) Before completing the order, during the online process, you can remove the quantities of products from your cart by clicking on the “remove” button.
  2. b) If the online order has been completed, you can contact us by e-mail at: sales@asthenis.gr or call +30 2117505100. One of our associates will assist you directly and inform you of all your options.

The shipping costs of returning the product are paid by the customer.

In case you have prepaid via bank deposit or prepaid debit/credit card, your refund will be made within 3 – 6 days to an account you will indicate in writing.

 

  1. Payment method
  1. Payment by credit or debit card.

Our online store accepts all credit/debit cards Visa, Mastercard and American Express. Your transactions in our online store are protected by the highest online security system (Viva Wallet), which guarantees a secure transaction environment. For purchases with your credit/debit card, follow carefully the instructions on our online store. You will be asked to fill in the order form, the number and expiry date of your credit/debit card, as well as the 3-digit number (CVV).

  1. Cash on delivery.

You have the option to choose the “cash on delivery” service as a method of payment, regardless the amount of your order. Cash on delivery is a service of the courier company or ours, which allows you to pay upon delivery of the product. The courier collects the amount of your order. If you choose this method of payment, there is a small surcharge on the cost of your order.

  1. Deposit to the account.

We also give you the option to pay the cost of your order directly to our bank account by indicating in the reason for the deposit the name and code of the order. After the payment is confirmed by us, your order will be sent. You can, for the most immediate service of your order, send us by e-mail to sales@asthenis.gr, a photo of the proof of deposit. Our account details are:

Beneficiary : ASTHENIS CAPITAL COMPANY

In case the deposit is made by another bank, the possible transaction costs are borne solely by the client and in no case by Asthenis.

 

  1. Delivery of the products – Shipping costs

Subject to the provisions of clause 8 regarding product availability, we will make every effort to complete your order unless there are exceptional circumstances.

There will be no shipping costs for your order, regardless the amount of your order.

The courier company we work with is ACS. For delivery times of ACS, please, visit their website or click HERE.

For deliveries within Attica, we use our own means. Indicatively, after we have sent you the message : “Order Confirmation” / “Under execution”, your order will be delivered within 3 working days.

Delays may occur in cases such as product adaptation to customer requirements, depending on the delivery area, customs controls, unforeseen circumstances (e.g. extreme weather conditions, strike, force majeure events) or when it is impossible to contact you by telephone and/or e-mail (if there is a problem with your order, either in relation to the product or in relation to its payment) for instance because the information you have entered is not correctly updated.

If, for any reason, we are unable to deliver on time due to our sole fault, we will let you know and offer you the option of either continue with the purchase by setting a new delivery date or cancel the order with a full refund.

The shipping costs of returning the product within Greece are paid by the customer unless the products are defective, in which case, they are paid by us (see below in detail section no.19 – defective products).

 

  1. Risk transfer and ownership of products

Liability for the goods is transferred to you as soon as you or a third party designated by you, other than the carrier, has acquired physical possession or control of the goods. Ownership of the goods passes into your hands either upon full collection by us of all sums due in respect of the goods, including shipping costs where applicable, or upon delivery of the goods if this occurs after collection.

 

  1. Right of withdrawal – conditions for accepting returns

For purchases made at a distance (e.g. via the internet/internet or by telephone), you have the right to withdraw from the contract, without justification, within 14 calendar days from the day you or a third party designated by you, other than the carrier, acquired physical possession or control of the goods.

In order to legally exercise the right of withdrawal, you must before the expiry of the withdrawal period: a) either send an e-mail to: info@asthenis.gr, or write to our contact form expressing your decision to withdraw from this contract in an express manner; and b) return the product to us in its original perfect condition in which it was delivered to you or provide us with clear and undisputed evidence that you have sent it safely, within 14 calendar days from the day you received it, accompanied always by the necessary legal documents, proof of payment and the return voucher.

Please, return the products in their original perfect condition as you received them (as new), without any processing, addition or other treatment and without opening the packaging, without any tears, damages or alterations to the packaging, using or including the original packaging, instructions and any other documents that may accompany them, otherwise you are not entitled to withdraw. In any case, the products you wish to return must be accompanied by the necessary legal documents (e.g. receipt, invoice), the receipts and the return voucher sent to you with the product. The delivery of the product to the courier company must be made according to the method indicated on our website.

Within fourteen (14) days of receipt of the product and once we have ascertained that it is in perfect condition, we are obliged to refund any sums you have paid to us using the payment method you have chosen to pay us. In the event that you have paid by payment card we will proceed immediately to instruct the card issuer and we will not be liable for any delays in crediting the amount of the price to you that are not attributable to us. If you have chosen cash on delivery as your method of payment, we will pay the amount you have paid to an account that you indicate to us in writing.

The shipping costs of returning the product are the customer’s responsibility.

If an invoice has been issued, then the return must be made by means of a delivery note.

We are not liable and will not compensate a consumer, nor will the withdrawal take effect in the event that damage has been caused to the goods or their packaging through the fault of the consumer.

You are not entitled to withdraw in any case provided for by law or herein in accordance with Greek law, such as products that are not suitable for return, for health protection or hygiene reasons, and which have been unsealed after delivery, such as personal care items, baby food, milk, refrigerator products or products made to your personalized order.

All returns must be made by courier companies and delivered to our head office. We reserve the right to refuse returns sent by post.

 

  1. Defective products

If you believe that the product you have ordered does not comply, at the time of delivery, with the terms of the contract, you must contact us within 14 days of receipt, either by sending an e-mail to sales@asthenis.gr or via our online contact form, describing in detail the product and its defect, indicating explicitly if you wish to replace it, credit the amount for future purchases or refund.

You can deliver the product, carefully wrapped in its original packaging, to the courier company we work with, together with all its legal documents.

After we have carefully examined the returned product, we will inform you by e-mail within a short period of time about your request. A replacement product or refund will be made as soon as possible and, in any case, within five (5) working days from the day we confirm by e-mail that you are entitled to a refund or replacement of the defective product. In the case of defective products, the amount paid will be refunded in full, including shipping costs and any other costs you may have incurred in returning the product. Your refund will be made by the same method as payment was made at the time of purchase. If you have chosen cash on delivery as your method of payment, the refund will be made to a bank account that you indicate to us in writing.

Refunds cannot be made to a third party/donor to whom we have delivered the product at your suggestion.

In the event that you send us a product which has been damaged or reduced in value through your fault, or in the event that you exercise your right after the deadline, then we will withhold the amount of the price, we will return the product to you and the transport costs will be borne by you.

 

  1. Force majeure events

ASTHENIS shall not become liable or responsible for any failure to perform or delay in performing any of its obligations under a contract caused by force majeure events.

A force majeure event is any act, event, failure to perform, omission or accident beyond our control and includes but is not limited to the following: a. strikes, walkouts or other union actions; b. Social unrest, riot, insurrection, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; c. Fire, explosion, storm, flood, earthquake, subsidence, pandemic or other natural disaster; d. Inability to use railways, ships, airplanes, motor vehicles or other public or private means of transportation; e. Inability to use public or private telecommunication networks; f. Acts, ordinances, laws, regulations or governmental restrictions; g. Any strike, breakdown or accident of ferry and postal services or other means of transport.

The performance of our obligations under any contract shall be deemed to be suspended for the period of the force majeure event and the time for performance of our obligations shall be extended for a period equal to the duration of such period. We will use all reasonable endeavours to bring the force majeure event to an end or to find a solution which enables us to fulfil our obligations under the contract despite the force majeure event.

 

  1. Transfer of Rights and Obligations

The contract between you and us is binding on both you and our respective licensees and assignees. You may not transfer, assign, or otherwise dispose of a contract, or any of your rights or obligations under it, without our prior written consent. We reserve the right to transfer, assign, subcontract or otherwise dispose of a contract, or any of our rights or obligations under it, at any time during the term of the contract. For the avoidance of doubt, any such transfer, assignment or other type of disposal shall not affect your statutory rights as a consumer or cancel, reduce or otherwise limit any explicit or implicit warranty we may have given you.

 

  1. Written Communication

Applicable law requires that some of the information or updates we send you should be in written form. When you use our website, you acknowledge that communication with us will be primarily in electronic form. We will communicate with you via e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic form of communication and acknowledge that all contracts, notices, information and other communications we provide to you electronically comply with any legal requirement that such communications must be in writing.   1. Governing Law – Jurisdiction

These terms are governed by Greek Law. The Courts of Athens, Greece shall have jurisdiction for the purpose of any dispute that may arise in connection with the operation and use of the website, if said dispute cannot be amicably resolved. Any dispute relating to the interpretation and the implementation of these terms and conditions, as well as any other matter in connection with the use of this website, shall be governed by Greek Law.

 

  1. Other Terms

The personal data protection is governed by the principles of the Regulation (EU) 2016/679 and the relevant national law that implements it.

In the event that any of the above terms is rendered incompatible to the legislation in force, it automatically becomes invalid, without in any way affecting the validity of the remaining terms.

Asthenis may enter into an agreement to assign its obligations to an appropriate third person.

The foregoing terms constitute the entire agreement with Asthenis, which reserves the right to amend or update or erase all the terms herein, without any notice. The amendment or review shall become effective after this document is updated regarding any change.
